“The Importance of Innocent Until Proven Guilty”

Everyone has been hearing about the zomato girl’s story and have their own presumptions about it. Some say that the girl is right while others have no idea about the guy’s story. What I feel is that the girl is making the guy’s ‘Bakra’ in order to extort money and be famous on social media and promote her work.  This is my personal opinion. Rest is on you to decide after reading both sides of the story.

HITESHA’S  STATEMENT: -

On, March 9, Tuesday; A Bengaluru based content creator and make-up Artist Hitesha Chandranee has alleged that her order was delayed and when she was talking to Zomato customer care to resolve the issue, the delivery guy barged into her house hit her on her nose, and then ran away.

Explaining the whole incident she said, "I ordered food from Zomato at around 3:30 pm which was supposed to get delivered by 4:30 pm. I didn't get my order on time for which I was constantly in touch with customer support to either cancel the order or wave off the charges as Zomato promises to deliver food on time. Meanwhile, the Zomato delivery executive came and started behaving rudely when I confronted him for the late delivery. I didn't open the door fully and I told him to wait as I was on a call with the support team to confirm is the order free, or if not free, then cancel it, through the small slit in the door.

I also gave him the choice to take the order back but he refused to take it back and started screaming that he is not my slave, and he will not wait, which was really threatening to me and I got scared. I shut the door but he barged in my house, snatched the order and punched me into my face. It was a very scary situation for me. I went to the hospital and there I came to know that my nose has been fractured for which I went under surgery. I am on a high dose of painkiller and antibiotics because of which I am able to talk.  I have filed an FIR and submitted a copy of my doctor's prescription.

KAMARAJ’S STATEMENT: -

Kamaraj is the delivery executive for Zomato. His father was a lawyer who died 15 years ago because of which he couldn’t complete his education. He further stated that he is the sole breadwinner of his family and his mother is a Diabetic.

He lost the job of the delivery executive as Zomato suspended him after the woman's complaint, but he refused the allegation and told that the woman verbally abused him first. He said I was expecting to get paid when I reached her place with the order as the payment option was cash on delivery. She questioned me, Why are you late?  For which I apologized to her and told her about the road blockage which is there due to civic works and there was a lot of traffic jam.

But she kept shouting. This is the first time I went through this kind of situation in my two year career with Zomato. Chandranee took the food and refused to pay. She was on a call with the Zomato chat support. Fearing he would lose the money Kamaraj pleaded her to pay him. I asked her for money she said that I am a slave and asked what can I do?  In the meantime, Zomato told me that the order was canceled from the customer end so I asked her to return the food but no cooperation was shown from her side. I decided to leave the premise without taking the food. When I moved towards the lift, she abused me in Hindi and threw slippers at me.

After which, Kamaraj said he used his elbows to make a shield and protect himself. He further said, When Hitesha was trying to push my hands, she accidentally hit her ring on her nose after which bleeding started. If anybody will watch closely at her injury, they can clearly judge how she got injured. That cut on her nose is due to a ring and I don't even wear a ring. I narrated the whole incident to Delhi's Zomato support team and they supported me and empathy was offered by them. The main problem is that there was no CCTV camera placed at her premises which could have helped me in proving my innocence.

ZOMATO STATEMENT ON THIS MATTER:-

Speaking on the incident, company founder Deepinder Goyal in a statement said Zomato's topmost priority is truth and that they were in constant touch with Chandranee and Kamaraj to provide them with Every support so that stories of both sides come into light. We are also assisting the police in whichever way asked. Goyal in his statement also said that Kamaraj has been temporarily suspended from active deliveries as per the protocol but is covering his earnings in the interim while there's an active police case investigation. The Zomato CEO also tweeted Kamaraj's performance. Kamaraj has made 5000 deliveries till now and has a 4.75 rating out of 5 which is one of the highest till now. He has been working with Zomato for the past 26 months.

Some Facts to be considered:-

    1.  Hitesha’s Followers on Instagram approximately increased within a week, now the followers are real or fake is the question one needs to think upon.

      2.  She has been charged with Section 341 (Wrongful Restraint), Section 355 (Assault)and  Section 504 (Criminal Intimidation).  Based on the complaint by the delivery boy.

      3. She said that she suffered from Nasal Bone Surgery and if the said surgery is done then   according to Google Search the healing takes place within a period of 6 weeks.

     4. Kamaraj's reviews on Zomato are the highest among other delivery boys. He is working with Zomato since 2 years and 2   months and no such incident before this has happened.

     It seems like people of India are in support of Kamaraj and have their own reasons to   believe in his story. Also his poor condition tells a different story to all.

It’s important that we raise our voice and stand for the right because “We are of the people, for the people and by the people”. Now you might be thinking, why should we stand up for what is right? What difference will it make?  Ultimately, right or wrong is going to be proved in the court of law. Agreed but our support helps the person who is going through some hardest times, emotionally and mentally.

A recent tweet which is claiming to be Hitesha’s roommate for almost 3 years in Bangalore. She used to take free pizza from Dominos and Pizza Hut in the past as well.

She claims that she has a picture of her and it’s her behavior to take free food and abuse. There are some other news too which are becoming the highlight of the case. Also Hitesha took her Instagram to request everyone to not post any opinion about this case until the trial is completed by the appropriate forum.

The reason for writing this blog is that there are many other incidents that take place every day but light is thrown on the ones that make their way to social media. The thing about social media is that it holds the power to turn any person into positive or negative. The problem exists when one party is familiar with social media and other party has no idea about it. Well, we hear that “Eyes say it all” but “Lies hide it all”.
